1. Introduction
Welcome to Oni Collection. These Terms and Conditions ("Terms") govern your use of our luxury travel concierge services, our website [www.onicollection.com] (the "Site"), and any related interactions with us. By engaging our services, accessing our Site, or submitting an inquiry, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.

2. Our Services
Oni Collection acts as a concierge and intermediary, arranging and coordinating travel-related services on your behalf with third-party suppliers (e.g., hotels, airlines, charter companies, tour operators). We are not a direct provider of travel services. All travel arrangements are subject to the terms and conditions of the actual service providers.

3. Client Responsibilities
You agree to:

  • Provide accurate, current, and complete information during the inquiry and booking process.

  • Ensure all travel documentation (e.g., passports, visas, vaccination certificates) is valid and in order.

  • Review all itinerary details, confirmations, and vendor terms promptly and notify us immediately of any errors.

  • Obtain adequate travel insurance, including cancellation, medical, and baggage coverage.

  • Conduct yourself in a manner that is respectful and lawful throughout your travels.

4. Fees, Payment, and Cancellation

  • Membership & Planning Fees: Membership dues and/or non-refundable planning fees are charged as outlined in your membership agreement or project proposal.

  • Third-Party Costs: All costs for travel services (e.g., accommodation, flights, tours) are due as per the payment schedule provided. These payments are often required in advance and are subject to the cancellation policies of the individual suppliers.

  • Cancellation by You: Cancellations must be submitted in writing. Cancellation penalties will be determined by the policies of the respective suppliers and can range from partial charges to 100% forfeiture, especially for last-minute cancellations. Your membership or planning fee is non-refundable.

  • Cancellation by Us: We reserve the right to cancel services if full payment is not received by the due date or if circumstances arise that make it impossible or unsafe to provide the service. We are not liable for cancellations due to force majeure events.

5. Limitation of Liability
To the fullest extent permitted by law, Oni Collection, its employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to:

  • Acts, errors, or omissions of third-party suppliers.

  • Loss or damage to property, injury, illness, accident, delay, or inconvenience experienced during travel.

  • Any event beyond our reasonable control, including but not limited to weather, natural disasters, acts of government, terrorism, or mechanical failures.

Our total liability for any claim arising from our services shall be limited to the total fees paid by you to Oni Collection for the specific service in question.

6. Privacy
Your privacy is important to us. Our collection and use of your personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Indemnification
You agree to indemnify and hold harmless Oni Collection and its affiliates from any claims, losses, liabilities, damages, and expenses (including legal fees) arising from your breach of these Terms, your violation of any law, or your use of third-party services booked through us.

8. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of Ukraine. Any dispute arising from these Terms or your use of our services shall be resolved through confidential, binding arbitration in Kyiv, Ukraine, rather than in court.

9. Modifications to Terms
We reserve the right to update or modify these Terms at any time. The updated version will be posted on our Site with a revised "Last Updated" date. Your continued use of our services after any changes constitutes your acceptance of the new Terms.
